These Subscription Terms (the “Terms”) govern the subscription services (the “Subscription Services”) offered through the MoePict app (the “App”), an AI-powered application for creating and editing cute, anime-style avatars and characters. These Terms supplement the MoePict Privacy Policy and User Agreement, which are incorporated herein by reference. By purchasing, subscribing to, or using the Subscription Services, you (the “User” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as the Privacy Policy and User Agreement. If you do not agree to any part of these Terms, you must not subscribe to or use the Subscription Services.
MoePict offers optional Subscription Services that provide users with enhanced features and benefits beyond the free version of the App. The specific features included in the Subscription Services may include, but are not limited to, unlimited avatar and character generation, access to exclusive character settings (such as premium accessories, expressions, poses, and backgrounds), ad-free usage, high-resolution image downloads, and priority customer support. The exact features of the Subscription Services are subject to change at our discretion, and we will notify users of any material changes through the App.
The Subscription Services are available on a recurring basis (e.g., monthly, annually) as specified at the time of subscription. All subscription plans are priced in the currency displayed at the time of purchase, and prices are subject to change without prior notice, though any price changes will not affect active subscriptions until the next renewal period.
To activate the Subscription Services, you must complete the subscription purchase process through the App’s designated payment portal. By completing the purchase, you authorize us to charge the payment method you provide (e.g., credit card, mobile payment service) for the full subscription fee applicable to the plan you select. You represent and warrant that you are authorized to use the payment method provided and that all payment information you submit is accurate and complete.
All subscriptions are set to automatically renew at the end of each subscription period, unless you cancel the subscription before the start of the next renewal period. We will charge the applicable subscription fee to your designated payment method on the renewal date. You will receive a notification within the App prior to each renewal, reminding you of the upcoming charge and renewal date. If your payment method fails to process the renewal fee, we may temporarily suspend your access to the Subscription Services until the payment is successfully processed. If payment remains unprocessed for a reasonable period, we reserve the right to terminate your subscription.
You may cancel your subscription at any time, and cancellation will take effect at the end of the current subscription period. No refunds will be provided for partial subscription periods, unused portions of the subscription, or already processed charges. To cancel your subscription, you must follow the cancellation instructions provided within the App’s settings or through the payment platform used to purchase the subscription (e.g., app store settings). We are not responsible for any failure to cancel your subscription due to incorrect following of cancellation instructions.
If you cancel your subscription before the end of the current period, you will retain access to the Subscription Services until the end of that period. After cancellation, your account (if applicable) will revert to the free version of the App, and you will no longer have access to the enhanced features of the Subscription Services.
Consistent with MoePict’s overall service model, the Subscription Services do not require you to create a separate account or provide additional personal information beyond what is necessary to process your subscription payment. Your subscription will be linked to the device you use to purchase the subscription, allowing you to access the Subscription Services on that device without logging in. If you switch devices, you may need to re-authenticate your subscription through the App using the same payment account used for the original purchase.
The Subscription Services, like all features of MoePict, do not collect, access, store, or process any facial information or facial images. Subscribing to the Subscription Services does not change this practice—you will never be required to upload, provide, or share any photos of real faces or facial data to access or use the Subscription Services. The enhanced features of the Subscription Services are limited to avatar and character creation tools and do not involve any facial recognition or facial data processing.
We reserve the right to modify, suspend, or discontinue the Subscription Services, or any part thereof, at our discretion, with or without prior notice. We may also add, remove, or modify any features included in the Subscription Services to improve the user experience or adapt to technical changes. If we make material changes to the Subscription Services that significantly reduce their functionality, we will notify users through the App and may offer a prorated refund or alternative subscription option at our discretion.
We also reserve the right to modify these Subscription Terms at our discretion. Any changes to these Terms will be posted within the App, and your continued use of the Subscription Services after the posting of revised Terms constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any changes.
You agree to use the Subscription Services in compliance with these Terms, the User Agreement, and all applicable laws and regulations. You are solely responsible for maintaining the security of your device and ensuring that no unauthorized person accesses your Subscription Services on your device. You agree not to share, transfer, or sublicense your subscription to any third party, and any unauthorized use of your subscription may result in immediate termination of the Subscription Services without refund.
You also agree that you are solely responsible for any User Content generated through the Subscription Services, and you retain ownership of such User Content as outlined in the User Agreement. The Subscription Services do not grant you any additional rights to User Content beyond what is provided in the User Agreement.
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use or inability to use the Subscription Services, including but not limited to damages for loss of access, loss of functionality, or any other monetary loss. This limitation of liability applies regardless of whether the damages are caused by negligence, breach of contract, or any other legal theory.
We shall not be liable for any damages arising from: (a) your use of the Subscription Services in violation of these Terms or the User Agreement; (b) unauthorized access to your subscription or device; (c) any errors or omissions in the Subscription Services; (d) the suspension or termination of your subscription in accordance with these Terms; (e) third-party actions or inactions; or (f) any other event beyond our reasonable control.
We reserve the right to terminate your subscription and access to the Subscription Services at our discretion, without prior notice, if you violate any term or condition of these Terms, the User Agreement, or the Privacy Policy. Upon termination, your access to the Subscription Services will immediately cease, and no refunds will be provided for any unused portion of the subscription.
You may terminate your subscription at any time as outlined in the “Subscription Cancellation” section above. Upon termination of your subscription for any reason, all licenses granted to you under these Terms will immediately terminate, and you shall cease all use of the Subscription Services.
You agree to indemnify, defend, and hold harmless the operator of MoePict (the “Operator”), its affiliates, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from: (a) your use of the Subscription Services; (b) your violation of these Terms, the User Agreement, or the Privacy Policy; (c) your User Content; (d) your violation of any applicable laws, regulations, or third-party rights; or (e) any unauthorized use of your subscription by a third party.
These Terms, together with the Privacy Policy and User Agreement, constitute the entire understanding between you and the Operator regarding your use of the Subscription Services. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Any disputes arising out of or related to these Terms or the Subscription Services shall be resolved through good-faith negotiation between you and the Operator. If the dispute cannot be resolved through negotiation, either party may pursue any legal remedies available under applicable law.
