This User Agreement the Agreement is a legal contract between you the User or you and the operator of MoePict the Operator or we, governing your use of the MoePict app the App, an local ai-powered application for creating and editing cute, anime-style avatars and characters. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions set forth in this Agreement. If you do not agree to any part of this Agreement, you must not use the App.
All information is processed locally, information is only retained on the user's local device, and when the user takes the initiative to delete the information, the information will be deleted, so the App does not collect any facial data.
By accessing or using any feature of the App, you confirm your acceptance of this Agreement and any updates or modifications we may make to it from time to time. We reserve the right to revise this Agreement at our discretion, and any changes will be posted within the App. Your continued use of the App after the posting of revised terms constitutes your acceptance of the updated Agreement. We encourage you to review this Agreement periodically to stay informed of any changes. We grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for your personal, non-commercial purposes only. This license allows you to use the App’s features, including selecting character settings character type, pixel art style, accessories, expressions, poses, backgrounds, etc., entering short prompts, and generating anime-style avatars, characters, stickers, and wallpapers for personal use.
You agree not to use the App for any illegal, unauthorized, or prohibited purposes, including but not limited to using the App in a way that violates any applicable laws, regulations, or third-party rights; generating, editing, or sharing content that is harmful, offensive, abusive, discriminatory, vulgar, obscene, violent, or infringing on the intellectual property rights of others; attempting to access, modify, or disrupt the App’s code or underlying technology; using the App for commercial purposes, including selling, licensing, or distributing any content generated through the App for monetary gain without our prior written permission; using automated tools, bots, or scripts to access or use the App; modifying, reverse-engineering, decompiling, or disassembling any part of the App; introducing malware, viruses, or other harmful software into the App or our systems; and interfering with other users’ access to or use of the App. All information is processed locally, information is only retained on the user's local device, and when the user takes the initiative to delete the information, the information will be deleted, so the App does not collect any facial data.
As with the App’s privacy practices, MoePict does not require you to create an account or log in with any personal credentials to use the App. You may access and use all features of the App freely without providing any account-related information, such as usernames, passwords, or email addresses for registration. This means you are solely responsible for any activity conducted through the App on your device, and you agree to keep your device secure to prevent unauthorized access to the App. All information is processed locally, information is only retained on the user's local device, and when the user takes the initiative to delete the information, the information will be deleted, so the App does not collect any facial data.
You retain ownership of all content you generate through the App, including avatars, characters, stickers, and wallpapers the User Content. However, by generating and using User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the User Content solely for the purpose of providing and improving the App’s services, including but not limited to processing your requests and storing your content locally on your device. This license does not allow us to share, sell, or distribute your User Content to any third parties for commercial purposes.
You agree that you are solely responsible for your User Content and that you have the right to generate, use, and distribute such content without infringing on the intellectual property rights, privacy rights, or other legal rights of any third party. You agree to indemnify and hold harmless the Operator from any claims, damages, or liabilities arising from your User Content or your use of the App in violation of this Agreement. We strive to make the App available at all times, but we do not guarantee that the App will be error-free, uninterrupted, or available 24/7. We may temporarily suspend access to the App for maintenance, updates, or technical issues without prior notice. We reserve the right to modify, update, or discontinue any feature of the App at our discretion, including adding new features, removing existing features, or improving the app’s performance. We may also require you to download and install updates to the App to continue using its services, and you agree to accept such updates.
To the maximum extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use or inability to use the App, including but not limited to damages for loss of data, loss of profits, or any other monetary loss. This limitation of liability applies regardless of whether the damages are caused by negligence, breach of contract, or any other legal theory.
We shall not be liable for any damages arising from your use of the App in violation of this Agreement; unauthorized access to your device or User Content; any errors or omissions in the App’s functionality; the loss or corruption of User Content stored locally on your device; third-party actions or inactions; or any other event beyond our reasonable control.
This Agreement shall remain in effect until terminated by either party. You may terminate this Agreement at any time by uninstalling the App from your device and discontinuing all use of the App’s services.
We reserve the right to terminate this Agreement and your access to the App at our discretion, without prior notice, if you violate any term or condition of this Agreement. Upon termination, your license to use the App shall immediately terminate, and you shall cease all use of the App. Any provisions of this Agreement that by their nature should survive termination including but not limited to liability limitations, indemnification, and intellectual property rights shall remain in full force and effect.
You agree to indemnify, defend, and hold harmless the Operator, its affiliates, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, and expenses including reasonable attorney’s fees arising from your use of the App; your violation of this Agreement; your User Content; your violation of any applicable laws, regulations, or third-party rights; or any other act or omission by you related to the App.
This Agreement constitutes the entire understanding between you and the Operator regarding your use of the App, and it supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws applicable to the Operator, without regard to its conflict of laws principles. Any disputes arising out of or related to this Agreement shall be resolved through good-faith negotiation between you and the Operator. If the dispute cannot be resolved through negotiation, either party may pursue any legal remedies available under applicable law.
